Code of Commercial Procedure

Civil justice in Russia is divided between two court systems different both in competence and in the quality of decisions.

When the Soviet Union collapsed, the creation of a decent court system all across the country which would deal with all types of disputes seemed a daunting and lengthy task. Thus, the best human and material resources went to commercial courts — arbitrazh, while what remained went to the courts of general jurisdiction where ordinary people would solve their ordinary disputes.

Proceedings in commercial courts are governed by the RF Code of Commercial Procedure (Арбитражно-процессуальный кодекс Российской Федерации). Its current version was adopted in 2002. By and large, this is a good document. Its distinctive characteristics are, above all, the speed of proceedings and the comparative ease of access to higher courts for appeal.
