Forum non conveniens

Forum non conveniens is a discretionary power that allows courts to dismiss a case where another court is much better suited to hear the case. Such dismissal means that a plaintiff has to refile his or her case in the more appropriate forum.

Strictly speaking, Russian courts cannot grant a forum non conveniens dismissal since the jurisdiction of each court is determined by law. At best, the court can transfer a case to another forum if both parties file such a motion on the ground that another forum is closer to the greater part of evidence.

The concept, therefore, does not exist in Russia and the term is not legally defined. We translate it somewhat differently, depending on context, by most often with a whole phrase — «неудобный суд для рассмотрения дела».
